Indonesia Urges Israel to Comply with International Obligations Towards Palestine

TEMPO.CO, JakartaForeign Minister Sugiono asserted five obligations that Israel must fulfill towards Palestine, during a session of the International Court of Justice (ICJ) in The Hague, Netherlands, on Wednesday, April 30, 2025.

"First, Indonesia submits that Israel is bound to comply with the obligation to ensure basic supplies as provided under in Articles 50 and 55 of the Fourth Geneva Convention," said Sugiono.

Sugiono specified that Israel must ensure that the civilian population in Palestinian territories is provided with essential supplies, including food, medical care, and other essential services.

"Second, Israel is obliged to agree on relief schemes, especially to fulfill basic necessities as provided under Articles 38, 59, and 62 of the Fourth Geneva Convention," stated Sugiono.

Sugiono mentioned that Israel is obligated to collaborate with international humanitarian agencies to develop aid schemes for the provision of food, medical care, and other essential services.

He emphasized that this step becomes even more crucial because the civilian population of Palestine is inadequately supported with basic necessities. 

Third, Sugiono urged Israel to be obligated to protect medical facilities, healthcare workers, and the provision of healthcare services to Palestinian residents. He requested that Israel refrain from attacking hospitals so that medical personnel can carry out their duties undisturbed.

"At this juncture, Israel has clearly failed to respect those obligations. Indonesia wishes to highlight the fact that one of these failures was evident in the event of the Israeli attack towards the Indonesia Hospital in Gaza in 2023,” he stated.

Fourth, Sugiono pushed for Israel to be obligated not to impose collective punishment based on Article 33 of the Fourth Geneva Convention. Collective punishment refers to the subjugation of Gaza residents through large-scale attacks.

"Israel must therefore ensure that any measure taken in the OPT does not punish the civilian population collectively. The legal principle is clear, individuals should not suffer for the actions of others," he said.

Fifth, Sugiono urged the prohibition of the transfer of Palestinian residents in accordance with Article 49 of the Fourth Geneva Convention.

Sugiono explained that any actions related to evacuation can only occur for compelling military reasons and must be temporary and not infringe on the rights of the population.

"Israel must respect this obligation and refrain from engaging in any action that would lead to the lawful transfer of civilians from the occupied territory," he said.

"Yet, what we have witnessed in Gaza is a de facto policy of permanent dispossession. Israel is deliberately conducting a policy of forced mass displacement accompanied by destruction of civilian infrastructure."
