TEMPO.CO, Jakarta - Vice Chair of the Indonesian Institute for Law Enforcement and Legal Reform (LP3HI), Kurniawan Adi Nugroho, has withdrawn the pretrial lawsuit regarding the transfer of the case involving former Deputy Attorney General for Special Crimes, Febrie Adriansyah, from the police to the prosecutor's office. The lawsuit was filed jointly with the People's Alliance for Justice and Welfare of Indonesia (ARUKKI) at the South Jakarta District Court.
"Yes, we have withdrawn it. The determination hearing will be this afternoon," Kurniawan said when contacted by Tempo on Tuesday, July 28, 2026.
Kurniawan explained that the reason for withdrawing the request is that Febrie has been named a suspect in a money laundering case and has been detained by the prosecutor's office. "Thus, the investigation into the alleged corruption committed by the suspect, Febrie Adriansyah, will not be discontinued," he said.
Previously, they filed the pretrial lawsuit because they believed that the police violated the criminal procedure law when transferring the handling of Febrie's case. According to the applicants, both the old and new Indonesian Criminal Procedure Codes (KUHAP) restrictively, strictly, and absolutely regulate that investigators can only hand over case files to prosecutors after the investigation process is complete.
In the case of Febrie, the investigation has not been completed. However, the police transferred the handling of the investigation to the Attorney General's Office for three cases involving Febrie. The three cases involve allegations of corruption and money laundering in handling cases related to PT Asabri, PT Krakatau Steel, and corruption in the Steam Power Plant (PLTU) project at PT PLN (Persero).
Kurniawan revealed that the withdrawal of the pretrial lawsuit is an appreciation for the prosecutor's office for daring to take firm action against their former high-ranking official. "The applicants have agreed to show appreciation and provide the law enforcement officials with the opportunity to continue the investigation process to completion by withdrawing the Pretrial lawsuit," he said.
Previously, Febri Diansyah, Febrie Adriansyah's lawyer, asked the investigators at the Attorney General's Office to explain the basis for the money laundering crime. In this case, the Attorney General's Office accused Febrie of practicing money laundering at PT Asabri.
Febri said that his client has not received an explanation from the Attorney General's Office regarding the detention of the former Deputy of the Special Crimes Division in the alleged money laundering case. "Legally, we have many questions that have unclear answers," said Febri at the Corruption Eradication Commission's detention house (KPK), South Jakarta, on Monday, July 27, 2026.
According to Febri, the investigators should explain the predicate of the crime before upgrading someone's status to a money laundering suspect. Because, according to Febri, if the predicate crime is not a corruption offense, the trial process will not take place at the Corruption Court.
Furthermore, according to Febri, the investigation order (sprindik) used by the investigators at the Attorney General's Office to ensnare the former Deputy of the Special Crimes Division is also still general in nature. "The question is, can a general investigation order be a predicate crime to designate someone as a money laundering suspect?" he said.
Meanwhile, Deputy Attorney General for Supervision, Rudi Margono, who led a team of nine in the investigation of the case, explained that Febrie Adriansyah was named a suspect and detained for the money laundering case. "In general, the allegations of money laundering committed by state organizers in their official capacity as prosecutors or structural officials during their tenure at the attorney general's office," said Rudi at his office in South Jakarta on Friday.
